Welcome to Clarky, a product owned and operated by Clark Interactive LLC ("we," "us," "our"). By accessing or using Clarky, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app.

1. Description of Service
Clarky is an AI chatbot service that you can embed into your website. Clarky begins by crawling your website and using the data it gathers as the chatbot's knowledge base. Users may also connect a Twilio phone number to enable voice-based access to the same chatbot information. All phone calls are recorded and transcribed for administrative review.

2. Account Registration
To use Clarky, you must sign in using either an email magic link or Google Sign-In. You agree to provide accurate and complete information during the registration process and to keep your account information up to date.

3. Use of the Service
You may use Clarky solely for lawful purposes and in accordance with these Terms. You agree not to:

• Use the service in a way that violates any applicable law or regulation;
• Attempt to reverse-engineer or interfere with the service;
• Transmit harmful code or disrupt the service.

4. Data Crawling and Storage
By using Clarky, you authorize us to crawl your website for the purposes of training and operating the chatbot. We store this data securely and use it solely to provide and improve the service.

5. Chat and Call Records
Clarky stores all chat interactions in a user dashboard for your access and review. All Twilio-connected phone calls are recorded and transcribed. You are responsible for maintaining the confidentiality of your dashboard and any data therein. 6. Twilio Integration

If you connect a Twilio phone number to Clarky, you authorize the app to receive and process voice input and provide AI-generated responses using your existing chatbot knowledge base. All calls are recorded and transcribed to improve service quality and for administrative use.

7. Termination
We may suspend or terminate your access to Clarky at our sole discretion, with or without notice, for any conduct that we believe violates these Terms.

8. Disclaimer of Warranties
Clarky is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to fitness for a particular purpose and non-infringement.

9. Limitation of Liability
To the maximum extent permitted by law, Clark Interactive LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of Clarky.

10. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles.
