Terms of Service

Welcome to Clarky, a product owned and operated by Clarky LLC ("we," "us," "our"). By accessing or using Clarky, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app.

1. Description of Service
Clarky is an AI-powered customer platform. It includes AI agents that respond to your customers over website chat, voice calls, SMS text messaging, and email; a CRM for managing contacts and conversations; appointment booking and calendar scheduling; forms and surveys; and outbound email and SMS campaigns. Clarky can crawl your website and use the content it gathers as an AI agent's knowledge base. Optional integrations let you connect third-party services, including Twilio phone numbers and Google Calendar, to extend these features. All phone calls handled through Clarky are recorded and transcribed for administrative review.

2. Account Registration
To use Clarky, you must sign in using either an email magic link or Google Sign-In. You agree to provide accurate and complete information during the registration process and to keep your account information up to date.

3. Use of the Service
You may use Clarky solely for lawful purposes and in accordance with these Terms. You agree not to:

• Use the service in a way that violates any applicable law or regulation;
• Attempt to reverse-engineer or interfere with the service;
• Transmit harmful code or disrupt the service;
• Send unsolicited or unlawful messages, including email or SMS that does not comply with applicable anti-spam and consent laws such as CAN-SPAM and the TCPA.

4. Data Crawling and Storage
By using Clarky, you authorize us to crawl your website for the purposes of training and operating the chatbot. We store this data securely and use it solely to provide and improve the service.

5. Chat and Call Records
Clarky stores all chat interactions in a user dashboard for your access and review. All Twilio-connected phone calls are recorded and transcribed. You are responsible for maintaining the confidentiality of your dashboard and any data therein.

6. Twilio Integration
If you connect a Twilio phone number to Clarky, you authorize the app to receive and process voice input and provide AI-generated responses using your existing chatbot knowledge base. All calls are recorded and transcribed to improve service quality and for administrative use.

7. Google Sign-In and Google Calendar
Clarky supports signing in with Google and offers an optional Google Calendar integration. If you sign in with Google or connect a Google Calendar:

• You authorize Clarky to access your Google user data as described on Google's consent screen and in our Privacy Policy, solely to provide the features you enable (for example, checking availability and creating calendar events for bookings);
• You represent that you own or are authorized to connect the Google account you link to Clarky;
• You may disconnect the integration at any time from your Clarky settings or from your Google Account permissions page, which stops all further access.

Clarky's use of information received from Google APIs adheres to the Google API Services User Data Policy, including its Limited Use requirements. See our Privacy Policy for full details on how Google user data is accessed, used, stored, and deleted.

8. Termination
We may suspend or terminate your access to Clarky at our sole discretion, with or without notice, for any conduct that we believe violates these Terms.

9. Disclaimer of Warranties
Clarky is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to fitness for a particular purpose and non-infringement.

10. Limitation of Liability
To the maximum extent permitted by law, Clarky LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of Clarky.

11. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles.
