Privacy Policy

Clarky LLC ("Clarky", "we," "us," "our") respects your privacy. This Privacy Policy explains how we collect, use, and protect your personal information when you use any Clarky services.

1. Information We Collect
  • Account Information: When you sign in via magic link or Google Sign-In, we collect your name, email address, and other profile information.
  • Chat Logs: We store all chat interactions in your user dashboard.
  • Website Data: We crawl and index content from your website to power the chatbot.
  • Twilio Integration: If you connect a phone number for Clarky Voice or Clarky SMS, we collect and process voice input, record calls, and generate transcriptions.
  • Google Calendar Integration (optional): If you choose to connect a Google Calendar, we access your list of calendars and calendar events, and create events on your behalf, as described in Section 3 below.
  • Analytics Data: We use Vercel Analytics to collect anonymized usage metrics such as page views, browser types, and user behavior.

2. How We Use Your Information
We use your information to:

  • Provide and operate the Clarky service;
  • Maintain and improve the Clarky app;
  • Display chat and call transcripts in the Clarky dashboard;
  • Communicate with you about Clarky updates and support;
  • Ensure security and compliance with our Clarky Terms of Service.

3. Google User Data
Clarky uses Google services in two ways: Google Sign-In for signing in to your Clarky account, and an optional Google Calendar integration. The Calendar integration is off by default and is only enabled when you explicitly connect your Google account through Google's consent screen. This section describes exactly what Google user data we access, how we use it, how we store and protect it, and how you can delete it.

What we access and why

  • Google Sign-In: If you sign in with Google, we access your basic profile information (your name, email address, and profile picture) solely to create and identify your Clarky account.
  • Google Calendar: If you connect a Google Calendar, we read your list of calendars and your calendar events in order to determine your availability for bookings, and we create calendar events when a meeting or appointment is booked through Clarky.
  • Connected account email: We access the email address of the Google account you connect so we can identify which account is linked to your workspace.

Limited Use disclosure

Clarky's use and transfer to any other application of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

In particular:

  • We only use Google user data to provide and improve the user-facing features described above. We do not use it for any other purpose.
  • We do not sell Google user data.
  • We do not use Google user data for advertising, ad targeting, or ad personalization.
  • We do not use Google user data to train or improve generalized artificial intelligence or machine learning models. When calendar data is processed by an AI model to provide a feature you have enabled (for example, an AI agent checking your availability to offer booking times), it is used solely to provide that feature, and our AI providers are contractually prohibited from using it to train their models.
  • No humans read your Google user data unless (a) you give us explicit permission, for example when asking for support; (b) it is necessary for security purposes, such as investigating abuse; (c) it is required to comply with applicable law; or (d) the data has been aggregated and anonymized and is used for internal operations.
  • We only transfer Google user data to third parties as necessary to provide the features described above, to comply with applicable law, or as part of a merger or acquisition with notice to you.

How we store and protect Google user data

Google user data is encrypted in transit (TLS) and at rest. OAuth access and refresh tokens are stored securely and are never exposed to other users or third parties. We never receive or store your Google account password. Access to production systems is restricted to authorized personnel.

Retention and deletion of Google user data

  • You can disconnect the Google Calendar integration at any time from your Clarky settings. Disconnecting deletes our stored OAuth tokens and stops all further access to your Google account.
  • You can also revoke Clarky's access at any time from your Google Account security settings at myaccount.google.com/permissions.
  • You may request deletion of all stored Google user data (including synced calendar event records) by contacting privacy@clarky.ai. We honor these requests within 30 days.
  • When your Clarky account is deleted, associated Google user data and tokens are deleted as well.

4. Data Sharing and Disclosure
We do not sell your personal data. We may share your data:

  • With service providers (e.g., hosting, analytics, Twilio) who help us operate Clarky services;
  • As required by law or legal process;
  • In the event of a business transfer, merger, or acquisition.

The above excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the text messaging service.

5. SMS Messaging Service
By providing your phone number and checking our consent box, you consent to receive text messages from Clarky at the phone number you provide. Standard message and data rates may apply. You may receive support messages, promotional updates, customer service updates, and appointment reminders at the number you provide.

You or your customers can opt-out of receiving further messages at any time by replying 'STOP' to any of our text messages. You can also contact us at privacy@clarky.ai to opt-out.

6. Data Collection and Usage
  • We will collect your phone number and name when you opt-in to our SMS messaging service.
  • This information is used to send you the text messages you have requested and for purposes as outlined in this Privacy Policy.
  • We will not send you text messages without your express consent.

7. Data Security
We implement reasonable safeguards to protect your information. However, no system can be 100% secure. These are the measures we take to protect user data:

  • Encryption: We ensure your personal information is encrypted with secure encryption algorithms during transmission and storage, ensuring that it is protected even if intercepted.
  • Firewalls: We use firewalls and other security technologies to protect our systems and your data from unauthorized access.
  • Data Breach Notifications: We will notify you in the unlikely event of a data breach, including notifying any affected users and law enforcement, as required by law.
  • Data Minimization: We collect only the minimum amount of your data necessary for the purposes specified in our Terms of Service, and your data is not retained longer than necessary.
  • User Controls: We provide where possible methods for users to control their data, such as accessing, correcting, or deleting their information, as well as options for opting out of certain data collection or sharing practices.

8. Cookies
We use cookies to improve your experience on our website. Cookies are small text files that are stored on your computer or device when you visit a website. We use cookies for a variety of purposes, including:

  • Essential cookies: These are necessary for the website to function properly and cannot be disabled.
  • Analytics cookies: These help us understand how users interact with our website and to improve its performance.

9. Data Retention
We retain your data for as long as necessary to provide the service, comply with our legal obligations, and enforce our agreements.

10. Your Rights
You may request access, correction, or deletion of your data by contacting us at privacy@clarky.ai.

11. Changes to this Policy
We may update this Privacy Policy from time to time. We will notify you of material changes via email or in-app notification.
